TUPE or not TUPE

More TUPE changes took place this month. From 1 May the transferor now has 28 days, rather than 14 days, to provide the transferee all employee liability information.

Employee Liability information includes names, ages, terms and conditions of employment, collective agreements, disciplinary matters and any tribunal claims relating to those employees involved in the transfer.

We think this is a sensible move giving the transferee more time to query details, assess the implications and deal with any concerns.

With more time to be thorough it may also avoid some problems we’ve seen such as the transferor forgetting to include anyone on maternity or long term sickness absence in the information they provided!
