What should employers be recording?

Most businesses are already capturing some HR data, but it is worth checking whether it is complete, accurate and easy to access.

This typically includes employment contracts, working hours, pay records, holiday entitlement, sickness absence and notes from return to work conversations. It should also cover things like disciplinary or grievance processes and probation reviews.

A little known ERA25 addition is that from 6th April 2026 it is now a legal compliance requirement to keep annual leave records (including TOIL and carryover) as well as holiday pay information for 6 years.

Individually, these areas are fairly straightforward. Together, they form the foundation of a well managed and compliant business.

Why accuracy matters in practice

Many issues arise not because something has been done incorrectly, but because it cannot be clearly evidenced.

For example, an employee may raise a question about holiday pay or absence management. Without clear records, it becomes difficult to explain or resolve the situation quickly.

This can lead to unnecessary confusion, delays or escalation.

When records are organised and up to date, most situations can be handled quickly and with confidence.

Moving away from spreadsheets

Spreadsheets and manual systems can work in the early stages of a business, but they often become harder to manage as teams grow and really are no longer sufficient when it comes to legal retention periods as they are too easily changed or misplaced.

Information can end up in different places, processes rely on individuals rather than systems, and consistency becomes more difficult to maintain.
