Employment Tribunals given power to impose financial penalties

From April 2014 the Employment Tribunals have been granted the power to impose financial penalties on employers who lose at tribunal if their behaviour when committing the breach of their employees’ rights is deemed to have aggravating features.

As yet we have no definitive answer as to what those aggravating features might be, beyond unreasonable behaviour, which one might argue breaching employment law was in the first place!  It is suggested that the fines will apply if the employer’s behaviour was intentionally unlawful or of actions were carried out with malice.

The fines for these aggravating features will range between £100 and £5,000 – but the employee who suffered such behaviour won’t see a penny of it….
