Key Information: What you need to know

An Employment Tribunal will make decisions about employment disputes between an employee and employer that have not managed to be resolved through other avenues of dispute resolution

Tribunal claims are frequently heard around issues such as:

  • Unfair dismissal
  • Redundancy
  • Discrimination

The Tribunal is fully independent, and if a Tribunal’s decision goes against an employer they can be made to pay compensation or re-instate the claimant

If a claim has been made by an employee against you, notification will come from the Tribunal who will send you the details of the claim and you will have 28 to submit a response.

Employment Tribunal FAQs

What happens if I receive an Employment Tribunal claim?

Receiving an Employment Tribunal claim can be unsettling. The first step is to carefully review the claim form (usually called an ET1). This document outlines the employee’s grievances and the remedies they are seeking. It’s crucial to gather all relevant documentation related to the claim, such as employment contracts, performance reviews, and any relevant communication. You have a specific timeframe (usually 28 days) to respond to the claim by submitting your own form (ET3).

How can I best prepare for an Employment Tribunal hearing?

Thorough preparation is key to a successful outcome. At vivoHR we will provide support through the entire preparation process.  This can include working closely with your legal counsel, assisting with gathering evidence and collecting all relevant documentation such as witness statements, emails, and any other relevant materials.  We can also help with preparation of witness statements and testimony delivery practice and training, so you are confident at the Tribunal, and can clearly and concisely answer questions.

What are the potential consequences of losing an Employment Tribunal claim?

The consequences of losing an Employment Tribunal claim can be significant. Potential outcomes include financial penalties, reinstatement or re-engagement of the employee, and if a negative outcome, it can damage your company’s reputation and make it more difficult to attract and retain staff.
