Holiday pay is definitely the hot topic of the moment! The European Court of Justice (ECJ) have now ruled that holiday accrued by employees who then die whilst still employed should be paid as part of the final salary settlement to their estate.

In the case in question the employee had been on extensive long term sick leave and had accrued over 100 days holiday which must now be paid to his widow & sole beneficiary.

This is a stark reminder to consider how you manage accrual of holiday pay and long term sickness leave such that wherever possible, employees don’t build up such a huge bank of time or payment in lieu owing to them.
